Personal Injury

A legal practice area covering physical, emotional, and economic harm a plaintiff suffers because of another party's negligence or wrongful conduct, typically arising from auto crashes, premises hazards, and workplace incidents.

Personal injury is a body of civil law that lets a plaintiff who has been physically, emotionally, or economically harmed by another party's negligence or wrongful conduct seek monetary damages. The plaintiff typically sues an at-fault driver, a property owner, an employer, a product manufacturer, or the responsible party's insurance carrier.

Personal injury cases include motor vehicle crashes, premises liability claims like slip and fall, dog bites, dram-shop cases, workplace injuries that fall outside workers' compensation, medical malpractice, product liability, and wrongful death. Each carries its own statute of limitations, evidentiary requirements, and damages structure.

Damages in personal injury cases generally cover medical expenses (past and projected), lost income, lost earning capacity, pain and suffering, loss of enjoyment of life, and, where the conduct was egregious, punitive damages. Many cases settle before trial through negotiation with the at-fault party's insurance carrier; a small fraction go to verdict.
